These Terms of Service ("Terms") govern your use of the Amurg Cloud service operated at hub.amurg.ai and the website at amurg.ai (collectively, the "Service"). The Service is provided by Ciprian Alexandru Grigore, IČO: 17947286, VAT: CZ686180093, with registered address at Jičínská 226/17, Prague 3 – Žižkov, 130 00 Prague 3, Czech Republic, operating under the brand name "Amurg" ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The self-hosted open-source version of Amurg is licensed separately under the Apache 2.0 License and is not governed by these Terms.
You must be at least 16 years old and capable of forming a binding legal agreement to use the Service. By using the Service, you represent that you meet these requirements.
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately if you become aware of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.
Amurg Cloud provides a hosted hub that relays messages between your browser and the agent runtimes you connect from your own machines. We provide the relay infrastructure, chat interface, authentication, and message storage. You are responsible for the agents you run, the runtimes you connect, and the content generated through them.
Amurg Cloud offers paid subscription plans billed monthly via Stripe. Prices are listed on our Pricing page.
You agree not to use the Service to:
We reserve the right to suspend or terminate your account if we reasonably believe you are violating these terms.
You retain ownership of all content you create, upload, or transmit through the Service, including chat messages, files, and agent configurations ("Your Content"). By using the Service, you grant us a limited license to store, relay, and display Your Content solely to provide the Service to you. We do not claim any ownership rights over Your Content.
You are solely responsible for Your Content and the output generated by the agents you connect. We do not monitor, endorse, or assume liability for agent-generated content.
Our collection and use of personal information is described in our Privacy Policy. By using the Service, you agree to the practices described therein.
We strive to keep the Service available but do not guarantee uninterrupted or error-free operation. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime.
To the maximum extent permitted by applicable law, including the laws of the Czech Republic and the European Union:
Our total aggregate liability for all claims arising from or related to the Service, regardless of the form of action (contract, tort, or otherwise), shall not exceed the lesser of (a) the total amount you paid us in the three (3) months immediately preceding the event giving rise to the claim, or (b) fifty euros (€50).
These limitations apply to the fullest extent permitted by law and shall survive termination of this agreement. Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, or any liability that cannot be excluded under applicable law (including mandatory provisions of Czech or EU consumer protection law).
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Specifically:
You use the Service entirely at your own risk. This disclaimer applies to the fullest extent permitted by applicable law, including the Czech Civil Code (Act No. 89/2012 Coll.).
To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Amurg, its owners, officers, employees, contractors, and agents from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal and professional fees) arising from or related to:
This indemnification obligation survives termination of this agreement and your use of the Service.
Either party may terminate this agreement at any time. You may terminate by canceling your subscription and deleting your account. We may terminate or suspend your access immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service ceases immediately. Sections 7, 10, 11, 12, and 14 survive termination.
These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions. Where applicable, the mandatory provisions of EU law, including the General Data Protection Regulation (GDPR), shall also apply.
Any disputes arising from or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of the Czech Republic. If you are a consumer resident in the EU, you additionally retain the right to bring proceedings in the courts of your country of residence, and you may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms. If you disagree with the changes, you should stop using the Service and cancel your subscription.
